Article 1 - Purpose
These General Rental Conditions (hereinafter "T&Cs") govern the contractual relationship between C&V Bébé en Provence (hereinafter "the Provider") and any adult individual (hereinafter "the Renter") making a reservation for childcare equipment via the Provider's website.
The Provider makes available to the Renter, for a determined period, one or more items or packs of childcare equipment under a short-term rental agreement.
Any reservation confirmed on the website constitutes full, complete, and unconditional acceptance of these T&Cs.
Article 2 - Minimum rental period
All reservations require a minimum duration of two (2) nights.
The rental period is calculated between the date the equipment is handed over and the return date specified at the time of booking.
Article 3 - Prices and rates
Prices are shown in euros inclusive of all taxes.
The Provider operates under the micro-enterprise scheme. VAT not applicable - Article 293 B of the French General Tax Code.
Rates for individual items:
- 2 to 4 nights: standard rate
- From 5 nights: 15% discount
- From 12 nights: 25% discount
Rates for packs:
- 2 to 4 nights: standard rate
- From 5 nights: 25% discount
- From 12 nights: 35% discount
The total amount is calculated automatically at the time of booking and presented before payment.
The Provider reserves the right to modify prices at any time. Reservations already confirmed remain subject to the rate in effect at the time of their confirmation.
Article 4 - Delivery and pickup
Delivery is available within a maximum radius of fifty (50) kilometers from Sénas.
Delivery fees are set as follows:
- 0 to 20 km: €5
- 20 to 30 km: €10
- 30 to 40 km: €15
- 40 to 50 km: €20
Beyond 50 km, delivery is not available.
On-site pickup in Sénas (13560) is free of charge.
Article 5 - Security deposit
Every reservation requires a security deposit in the form of a secure card imprint via Stripe.
The deposit amount is indicated before the reservation is confirmed.
The Renter expressly authorises C&V Bébé en Provence to charge all or part of the amount guaranteed by the card imprint to cover any sums due under this agreement, in particular in the event of:
- loss;
- theft;
- damage;
- equipment returned incomplete;
- late return;
- exceptional cleaning charges;
- non-compliance with these T&Cs.
Any use of the deposit will be communicated to the Renter in advance with justification of the amounts claimed.
The card imprint is released within a maximum of three (3) days after the equipment is returned, provided no damage is found.
Article 6 - Handover and acceptance of equipment
Equipment is handed over clean, disinfected, inspected, and in perfect working order.
The Renter has twenty-four (24) hours from the handover to report any anomaly or non-conformity in writing.
If no complaint is made within this period, the equipment is deemed to be conforming, complete, and accepted without reservation.
Photos of the delivered equipment will be taken to document its condition.
Article 7 - Use of equipment
The Renter agrees to:
- use the equipment in accordance with its intended purpose;
- follow the manufacturer's instructions;
- ensure permanent supervision of the child;
- maintain the equipment in good condition;
- not disassemble, modify, or repair the equipment;
- not sublet, lend, or transfer the equipment to a third party.
The equipment remains the exclusive property of C&V Bébé en Provence throughout the rental period.
Article 8 - Renter's liability
The Renter assumes legal custody of the equipment from the moment of handover until its effective return.
The Renter is liable for any loss, theft, degradation, or damage occurring during this period.
Repair or replacement costs may be charged to the Renter and deducted from the deposit.
Article 9 - Special case: car seats
Any car seat that has suffered an impact, accident, or collision, even minor, must be reported to the Provider immediately.
For safety reasons, the Provider may require full replacement of the affected seat at the Renter's expense.
Article 10 - Return of equipment
Equipment must be returned:
- on the scheduled date;
- clean;
- complete;
- with all accessories included.
Any missing accessory may be charged.
If exceptional cleaning is required due to the condition of the returned equipment, additional charges may apply.
Article 11 - Late return
Any unauthorised delay may result in additional days being charged at the current rate.
After 24 hours without contact from the Renter, the equipment may be considered unreturned and its replacement value charged.
Article 12 - Cancellation
More than 48 hours before the start of the rental: full refund.
Less than 48 hours before the start of the rental: 50% refund of the reservation amount.
In the event of a no-show: no refund.
The Provider reserves the right to cancel a reservation in the event of force majeure or exceptional equipment unavailability. In such cases, all amounts paid will be fully refunded.
Article 13 - Right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to rental services for specific dates or periods.
The Renter expressly acknowledges this exclusion when confirming their reservation.
Article 14 - Personal data
Personal data collected is necessary for managing reservations and commercial relationships.
Data processing is carried out in accordance with applicable regulations and the privacy policy available on the website.
Article 15 - Consumer mediation
In accordance with Articles L.611-1 et seq. of the French Consumer Code, the Renter may use a consumer mediator free of charge after an attempt at amicable resolution of the dispute.

Article 16 - Applicable law and dispute resolution
These T&Cs are governed by French law.
In the event of a dispute, the parties shall endeavour to reach an amicable solution.
Failing amicable agreement, the competent courts shall be determined in accordance with applicable legal rules.
Contractual validation
Before any payment, the Renter acknowledges having read these T&Cs and accepts them without reservation.
Confirming the reservation and making payment constitute an electronic signature with the same legal value as a handwritten signature.
